Right of access
The legislative process regarding accessibility continues to evolve in response to the increasingly widespread demands for transparency in public action, shaping different forms of access. In particular, the current legislation provides:
- Access to administrative documents pursuant to Article 22 of Law No. 241/1990 and subsequent amendments and integrations. It may be requested by anyone with a direct, concrete, and current interest corresponding to a legally protected situation related to the document for which access is requested.
- Simple civic access, governed by Article 5, paragraph 1, of Legislative Decree No. 33/2013 as amended by Article 6 of Legislative Decree No. 97/2016, concerning “documents, information, and data” subject to mandatory publication that the administration has failed to publish, and exercisable by “anyone,” regardless of a module di richiesta di accesso civico semplice. - Generalized civic access governed by Article 5, paragraph 2, of Legislative Decree No. 33/2013 as amended by Article 6 of Legislative Decree No. 97/2016, concerning data and documents held by public administrations “in addition to those subject to publication” pursuant to Legislative Decree No. 33 of 2013. In this case as well, the right is granted to “anyone,” regardless of any specific qualification requirement; with generalized access rights, in a completely different perspective from that of Law No. 241 of 1990, the legislation aims to encourage “widespread forms of oversight over the performance of institutional functions and the use of public resources” and to “promote participation in public debate.” Download the module generalized civic access request form.

Requests for access to administrative documents or for generalized civic access to documents held by the Directorate-General for Digitalization and Communication must be submitted to the email address: dg-dc@cultura.gov.it
Alternatively, the request for generalized civic access can be submitted to:

Pursuant to Article 5, paragraph 7, of Legislative Decree No. 33/2013, in cases of total or partial denial of access or failure to respond within the deadline, the applicant may submit a review request to the officer responsible for the prevention of corruption and transparency. Against the decision of the competent Administration or, in the case of a review request, against that of the officer responsible for the prevention of corruption and transparency, the applicant may appeal to the Administrative Court (TAR) pursuant to Article 116 of the Code of Administrative Procedure under Legislative Decree No. 104/2010.
